The HCAA has established a clear framework of fines for air carriers, as well as a formal administrative procedure for their imposition, in order to ensure the implementation of passenger rights, as provided for in Regulation (EC) 261/2004, in cases of travel disruption due to denied boarding, long delay, flight cancellation.

The stipulated fines concern violations related to the failure of air carriers to provide:

• Compensation
• Assistance and Care
• Information to passengers regarding their rights

Violations are identified by the Passenger Rights & Air Carriers Operating Licensing Section, which drafts a relevant violation report and invites the liable air carrier to submit a written statement of its views. The final decision to impose a fine is issued by the Governor of the Hellenic Civil Aviation Authority and is served via registered mail to the interested party.

It is noted that, pursuant to Decision 26825, the procedure may also be applied to identified violations dating from the establishment of HCAA onwards.
