Hellenic Civil Aviation Authority fully complies with the requirements of the General Regulation of Personal Data Management (EU) 2018/1725, articles 72 and 73 of Regulation (EU) 2018/1139 and Articles 15 and 16 of Regulation (EU) 376/2014, regarding the data contained in the incident reports as well as their accompanying documents.
The right of access to the above information is strictly limited to those officials of the Authority who are directly involved in the collection, storage, protection, exchange, dissemination, and analysis of incidents. Authority personnel who have access to incidents and possibly personal information, such as the names and addresses of individuals, sign a special confidentiality statement that explicitly states their obligations regarding the confidentiality and/or protection of personal data.
In the context of the safety culture, the main objective of HCAA regarding the processing of incident reporting data is to use the relevant information to improve the level of civil aviation safety.
Authority ensures the continuous development and maintenance of a "reporting culture" based on trust, in which all those who report are sure that the data provided are processed by those who have been entrusted with the maintenance, processing, access, and the use of the data, in accordance with the legal framework and not used arbitrarily or abusively.
In order to ensure confidence in the HCAA’s reporting system, without prejudice to applicable rules of law, HCAA ensures that the data of the reported incidents are not used against the reporting parties and are used in the interests of aviation safety.
HCAA ensures that the procedures followed for the confidentiality of information from incidents and the protection of personal data are in accordance with the provisions of the applicable legal framework.
Finally, HCAA is committed to strict compliance with procedures, regarding the information shared with the interested parties referred to in ANNEX II of EU 376/2014, which are obliged to declare compliance with the principles of confidentiality.
This DECLARATION OF CONFIDENTIALITY is reviewed, when deemed necessary by the Administration, as to its continued suitability.
